When we refer to "you" in this Personal Data Protection Policy, it is because it directly concerns you as a NUAGER customer, whether you have placed an order on the NUAGER site, created a customer account without ordering, or browsed as a visitor without creating an account or placing an order.

NUAGER operates the NUAGER Site and, as such, carries out various processing activities on your data as data controller.

3.1. When do we collect your personal data?
Your personal data may be collected if you visit the NUAGER site using cookies, if you create a customer account on the NUAGER site, place an order for one of our products or services, or consent to receive our newsletters (SMS, emails).
Your personal data helps us improve your browsing experience on the NUAGER site and offer you a more personalized experience. This allows us to process your orders efficiently, offer installment payment options, prevent fraud, process refunds, and manage your reviews.
3.2. Your browsing on the NUAGER Site

To manage and process your orders, we use your data.

3.4. Installment payment
For orders involving installment payment and for certain customers, your data is processed to offer you this payment option. The execution of the contract between both parties is the legal basis for data processing. However, your consent remains the basis for processing your banking data.
3.5. Customer reviews
To share your reviews with our customers and visitors and allow you to leave your opinion on the NUAGER site, we use your data on the legal basis of your consent or legitimate interest.
3.6. Payment recovery and fraud prevention
To enable payment recovery and fraud prevention, we use your data.
This also allows us to ensure payment security.
The execution of this contract between both parties and the legitimate interest of NUAGER as data controller are the legal bases for this processing.
3.7. NUAGER advertising operations
NUAGER's advertising operations are managed using your data.
This enables us to grow our customer and prospect database, manage technical prospecting maintenance and activities, commercial statistics and advertising campaign studies, updates to prospecting files managed by the body responsible for handling objections to telephone marketing, solicitations, competitions and lotteries, or any other promotional operation excluding online gambling.
The legal bases for the purposes described above are the user's consent or the legitimate interest of NUAGER.
4. WHERE DOES YOUR DATA GO?
Your data is shared with several internal NUAGER departments.
It is not sent to third parties, except in the situations described below:
To process your orders, your personal data may be shared with various service providers specializing in banking transactions, customer relations, after-sales service, delivery, IT development, site management, or the provision of guarantees or insurance.
For installment payment, your data may be shared with providers such as payment and transaction centers (banks, etc.), or call centers for business process or customer experience management, or, for reviews, with a review collection and processing manager.
NUAGER's advertising operations are managed, using your data, with advertising clients and advertisers.
5. DATA RETENTION
Data collected by NUAGER is retained only for the time and assistance necessary to implement and fulfill the operations described in paragraph 3 of our personal data policy.
We retain certain data collected by NUAGER for a set period:
In current archives for prospects, for 3 years from the customer's last contact (accessible to NUAGER departments). We do not carry out intermediate archiving of this data (for data of administrative interest for certain departments, such as disputes, retention periods are set by applicable limitation rules).
For orders, your data will be archived in current archives for 5 years from the end of the customer's order use, and in intermediate archives for 5 years from the end of current archive retention. The same applies to customers.
Banking data is archived in current archives for the entire validity period of the bank card (plus one day). No intermediate archiving is carried out for banking data.
Cookies and their use and retention periods are detailed in paragraph 7 of our policy.
6. EXERCISING YOUR RIGHTS
6.1. You have the right to request access, modification, and rectification of your Data.
6.2. You have the right to request restriction of processing of your Data.
Important note: to do so, you must contest the accuracy of your personal data for the time needed to verify its accuracy. Or if you believe our use of your personal data is unlawful and you request a restriction of use rather than deletion. We no longer need your data for the purposes described in paragraph 3, but your data is still needed for establishing, exercising, or defending legal claims, or if you decide to exercise your right to object while verification is underway to determine whether our legitimate grounds override yours.
6.3. You have the right to request deletion of your Data.
If you request deletion of your personal data, NUAGER may still retain it in an intermediate archive format for the time necessary to meet its legal, accounting, and tax obligations.
6.4. You have the right to exercise your right to object to processing carried out for commercial prospecting purposes.
In the case of email prospecting, you have the right to request modification or unsubscription from newsletters by clicking the "unsubscribe" hyperlink available in all newsletters, or by visiting the NUAGER site contact page directly.
In the case of SMS prospecting, you can unsubscribe by sending "STOP SMS" by text to 36007, or by visiting the NUAGER site contact page.
6.5. You have the right to submit post-mortem instructions regarding the retention, deletion, and communication of your personal data.
In the absence of such instructions, your successors and heirs may contact NUAGER to access the uses of this data and enable the "organization and settlement of the deceased's estate" and/or close the account on the site and/or request that processing of personal data cease.
You may also request that your data not be communicated to a third party in the event of death.

This is how we can offer and implement automated customer identification and "pay in 4 installments" options. This is based on the analysis of different variables relating to the type of products, services ordered, or customer profile.
If the risk is assessed statistically as too high (fraud/non-payment), this payment option will not be offered.
However, if you wish, you can request human intervention even when decisions are automated — you will be able to express your view and/or object to the automated decision.
11. POLICY UPDATE AND REVIEW
Our personal data policy will be updated whenever necessary to remain aligned with applicable data protection regulations (at least every three (3) years).
